ACCC granted interlocutory injunction in IVF merger case

The ACCC has today been granted an interlocutory injunction to restrain Virtus Health from completing its acquisition of Adora Fertility until court proceedings on the substantive merger issues are finalised.

The ACCC was conducting an informal merger review when the parties announced their intention to complete. The ACCC sought an urgent injunction on 13 October and had been granted an interim injunction on 14 October.
