Coles applies for review of ACCC determination opposing acquisition of Kalgoorlie supermarket and liquor site
Following a Phase 2 assessment the ACCC concluded that ‘Coles’ proposed acquisition would likely have the effect of substantially lessening competition in the retail supply of groceries by supermarkets in Kalgoorlie.’
Coles has now applied to the Australian Competition Tribunal for a review of that application.
The Tribunal has recently published a practice direction in relation to Reviews of acquisition determinations.
The matter is set to be heard before Justice O’Bryan (President), Dr Ray Steinwall and Professor David Byrne from 9 November 2026.
