ACCC opposes Coles’ acquisition of Kalgoorlie supermarket and liquor site
Following a Phase 2 assessment the ACCC has concluded that ‘Coles’ proposed acquisition would likely have the effect of substantially lessening competition in the retail supply of groceries by supermarkets in Kalgoorlie.’
The determination (Coles - supermarket and liquor site in Kalgoorlie, WA, MN-01068, Phase 2 Determination: Acquisition must not be put into effect, 30 June 2026) states:
1.4 The ACCC has determined under section 51ABZE(1) of the Act that the Acquisition must not be put into effect. The ACCC is satisfied that the Acquisition, if put into effect, would, in all the circumstances, be likely to have the effect, of substantially lessening competition in a market.
This is the second concluded Phase 2 assessment under the new merger regime and the first opposing a merger.
