ACCC publishes FY25/26 data on the new merger control regime

The ACCC has published data on the first year of the new merger control regime (the first six months being voluntary).

The data is provided in spreadsheet form and includes (with some key findings listed below):

  • the number of notifications and notification waiver applications received

    • Total notification waiver applications (since 1 Jan 2026): 286

    • Total notifications: 158 (13 made voluntarily in 2025)

  • the number of determinations made and their outcomes

    • Total Phase 1 matters approved: 115

    • Total Phase 1 matters progressed to Phase 2: 6

    • Total Determinations (notification waivers + notifications): 365

  • how long assessments took

    • 92% of notification and notification waiver determinations assessed within 20 business days

  • the types of acquisitions considered

    • For notifications, 75% involved horizontal acquisitions

  • the industries involved in the acquisitions based on Australian and New Zealand standard industrial classification (ANZSIC)

    • The largest category was manufacturing (34 notifications and 54 notification waiver applications) followed by provissional, scientific and technical services (28 notifications and 54 notification waiver applications)
