ACCC alleges egg cartel

The ACCC has alleged that Australia’s biggest egg supplier, Sunny Queen, and 11 other egg producers and suppliers cooperated on the production and supply of eggs in Australia in contravention of Australia’s cartel laws. It is alleged the conduct involved coordination in relation to production volumes, distribution, expansion plans and more.

In addition to alleged breaches of the cartel prohibitions in ss 45AJ and 45AK, the ACCC alleges the respondents engaged in concerted practices; this represents the first time the ACCC has brought proceedings alleging concerted practices since the prohibition was introduced in 2017.

It is also alleged that:

  • Sunny Queen Pty Ltd engaged in exclusive dealing in contravention of s 47

  • Hall & McLean Pty Ltd acquired Yarranlea in contravention of s 50

  • Kinross was knowingly concerned the contraventions of s 47.
