ACCC plans to revoke RPM notification

The ACCC has announced it plans to revoke a resale price maintenance (RPM) notification lodged by Weldclass, which would have prevented retailers selling certain machines at a discount.

The RPM notification was lodged on 4 October 2019. The ACCC has now announced it proposes to revoke the notification on the basis that any public benefits would not outweigh the detriments likely to result from reduced competition. In particular, Commissioner Ridgeway indicated that the ACCC was ‘not convinced that consumers necessarily need high levels of service for the Weldclass machines’ and that ‘retailers should generally be free to set their own prices’.

The consultation period for the draft notice ends on 30 March with a final decision expected in April.
