Sydney hailstorm 'perfect opportunity' to increase prices

Two Sydney roofing companies - ANZ Roofing Pty Ltd and Ivy Contractors Pty Ltd - have provided enforceable undertakings to the ACCC acknowledging that they had discussions on pricing following Sydney hailstorms.

One of the directors of ANZ Roofing (Burtenshaw) posted a photo of large hailstones on industry Facebook groups with the caption: ‘I think this latest storm is the perfect opportunity for the roofers of Sydney to increase pricing across the board as a standard that doesn’t decrease!

In their enforceable undertaking ANZ Roofing and Burtenshaw admit that this and related conduct ‘likely constituted an attempt to contravene, or an attempt to induce a contravention of, s 45AJ of the CCA through the fixing, maintaining or controlling of prices for the supply of roofing services in the greater Sydney area.’

Brent Callan-Kerkenezov, the sole director of Ivy Contractors, replied to Burtenshaw’s post with the comment ‘Let’s all agree that we start from $65 and go up’.

In their enforceable undertaking Callan-Kerkenezov and Ivy Contractors accept that this and related conduct ‘likely constituted an attempt to contravene, or an attempt to induce a contravention of, s 45AJ of the CCA through the fixing, maintaining or controlling of prices for the supply of roofing services in the greater Sydney area.’
