B&K Holdings v Garmin dismissed by consent

The private proceedings by B&K Holding against Garmin Australasia (QUD66/2018) have been dismissed by consent and without admissions (18 November).

B&K had alleged Garmin breached s 46 (as amended by Harper) by way of predatory pricing. An application for summary judgment by Garmin failed in February (B&K Holdings (Qld) Pty Ltd v Garmin Australasia Pty Ltd [2019] FCA 64).
